§ 1 Scope & Formation of Contract

The business relationship between SOS-ID GmbH and the customer is governed exclusively by the following General Terms and Conditions. We will only accept deviating or supplementary conditions of the customer if we have expressly agreed to their validity in writing.

For customers who have purchased our SOS-ID chips from third parties, these GTC apply with the exception of provisions relating to our delivery obligations and remuneration.

The presentation of our products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the “Order with obligation to pay” button, you place a binding order. Confirmation of receipt of your order is sent together with acceptance via automated e-mail. The purchase contract is concluded upon receipt of this e-mail.

§ 2 Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you (who is not the carrier) took possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (e.g. letter, fax, e-mail). You may use the enclosed model withdrawal form for this purpose, though it is not mandatory. It is sufficient to send the notification before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery), without undue delay and no later than fourteen days after the day on which we receive notification of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods. You must return the goods within 14 days of notifying us of your withdrawal. You bear the direct costs of returning the goods.

§ 3 Service Description

SOS-ID GmbH provides the user with a digital platform for recording, managing and making available personal emergency and health data. The stored information can be retrieved by third parties in an emergency via an SOS-ID QR code or an individual ID number.

User Account and Profiles

Upon initial registration, the user creates a personal user account. Within this account, multiple personal profiles (e.g. for family members) can be created and managed. Individual personal and medical data can be stored for each profile.

The user can:

  • set profiles to active or inactive (visible / not visible),
  • specify which information is displayed in an emergency,
  • assign specific SOS-ID products to individual profiles.

Each SOS-ID product can be assigned to one profile at a time. The assignment can be changed by the user at any time.

Free usage period: 12 months from registration

Extension: Only with the user's express consent (in writing or electronically)

Advance notice: At least four weeks before the free usage period expires

Data That Can Be Stored

The user can record and manage the following information in particular:

  • Personal contact details,
  • medical emergency information (e.g. blood type, allergies, medications, conditions),
  • supplementary patient details (e.g. surgical history, preventive care notes, advance directives),
  • health insurance information.

Only the information released by the user will be displayed in an emergency.

Responsibility for Content

The entry, accuracy and currency of stored data is the sole responsibility of the user. SOS-ID GmbH provides only the technical infrastructure. No medical advice, review or assessment of content is provided.

Access and Data Security

Employees have no regular access to protected emergency data. Only information publicly released by the user is visible. Access to non-public data is only possible in justified exceptional cases and exclusively by authorised IT specialists.

Emergency Use and Service Limitations

⚠ Important Notice: SOS-ID serves as a digital information system to support emergency situations and does not replace medical care or emergency treatment. Access to stored data requires that the QR code or ID number is used by a third party and that the platform is technically accessible at the time of retrieval. SOS-ID GmbH does not guarantee that stored data will actually be accessed in an emergency.

Transferability of the Chip

SOS-ID products can be assigned by the user to another person. Use of an SOS-ID product requires an active profile assignment by the user.

Before passing on the product, the user is obliged to remove it from the existing profile and assign it to a new profile, or to remove the assignment entirely.

The user is responsible for making the assignment correctly. SOS-ID GmbH assumes no liability for damages arising from incorrect or omitted reassignment.

Loss or Theft of the Chip

In the event of loss or theft of an SOS-ID product, the user is obliged to immediately deactivate the affected ID number or remove the profile assignment in order to prevent unauthorised access to stored data.

Deactivation or modification of the assignment can be performed at any time via the user account.

The user is responsible for timely blocking or adjustment. SOS-ID GmbH assumes no liability for damages arising from delayed or omitted action.

§ 4 Prices and Payment

The prices shown in the shop on the day of the order apply, in euros, including statutory VAT, plus shipping costs.

Payment methods: Direct debit, credit card, PayPal, advance payment

Payment due: Within 5 days of receipt of invoice

Payment processing: Stripe Technology Company Limited, Dublin, Ireland

Non-EU deliveries: Net (excluding German VAT); any customs duties, taxes and import charges are borne by the buyer

§ 5 Retention of Title

The goods remain our property until full payment has been received.

§ 6 Term, Extension, Basic Mode and Termination

The user agreement is concluded for an indefinite period. From the date of registration, the digital emergency data service is available free of charge for a period of 12 months.

Before the free usage period expires, the user will be notified at least four weeks in advance of the end of the term and the option to extend the service on a paid basis. An extension requires the user's express consent. There is no automatic renewal or subscription.

Membership: Refers to the service, not to individual SOS-ID products

Multiple products: Multiple SOS-ID products can use the same service

If the service is not extended, the user account is automatically switched to a restricted free Basic Mode. The account remains active and can continue to be used, but with limited functionality.

Basic Mode

Available: Personal information and two emergency contacts – retrievable in an emergency

Not displayed: Medical conditions, medications, allergies and other health data

Data storage: Health data remains stored until reactivation or account deletion

Editing: Changes or additions to health data not possible or only limited

Reactivation: Full functionality available at any time via paid service extension

Termination

Termination by user: At any time, without giving reasons – via account deletion or e-mail to info@id-no.com

Termination by SOS-ID: We waive our right of ordinary termination. The mutual statutory right to extraordinary termination for good cause (e.g. serious misuse of the platform, hacking attacks or upload of illegal content) remains unaffected.

Effect of termination: Access ends, data is deleted (subject to statutory retention obligations)

Return: No return of SOS-ID products required

§ 7 Death of a User

In the event of a user's death, the contract passes to the heirs in accordance with statutory provisions. However, we support bereaved relatives with a quick and straightforward process.

Deletion or complete deactivation of the account can be requested informally by e-mail to info@id-no.com. SOS-ID GmbH reserves the right to request appropriate proof (e.g. death certificate) in individual cases if there is reasonable doubt as to the legitimacy of the requesting person.

Since SOS-ID profiles contain highly personal health data, transfer of the existing account to another person or modification of the data is excluded. The account will be deleted promptly and irrevocably upon request by the bereaved.

§ 8 Obligations of the Customer

The customer is obliged to provide truthful information when registering on ID-No.com and to keep their data up to date. This applies in particular to contact details and – where stored – to medical emergency information.

§ 9 Warranty

Statutory warranty rights apply. No additional guarantees are provided.

§ 10 Liability

We are fully liable for intent and gross negligence, as well as for injury to life, body or health. In the event of slightly negligent breach of material contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for the contract. Any further liability is excluded.

Subject to the foregoing provisions on liability for intent and gross negligence, we do not guarantee the continuous and uninterrupted availability of the id-no.com platform in an emergency.

§ 11 Data Protection

We process personal data exclusively for the purpose of contract performance and in accordance with statutory requirements. When using the platform to store medical data, processing takes place only with the user's express consent.

§ 12 Right to Amend

SOS-ID GmbH reserves the right to amend these GTC and the scope of the platform's services for good reason (e.g. legislative changes, technical developments, changed market conditions).

Registered users will be notified of material changes by e-mail at least four weeks before they take effect. If the user does not object within four weeks of receiving the notification, the changes are deemed accepted. The notification will expressly draw attention to this right to object.

In the event of an objection, SOS-ID GmbH is entitled to terminate the contract by ordinary notice at the time the changes take effect.

§ 13 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Choice of Law

German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence.

§ 15 Storage of Contract Text

We do not store the contract text permanently. You can print your order data immediately after submitting your order. You will also receive an order confirmation with all contract details by e-mail.
